Introduction

MiaCreate is an AI-powered creative and marketing-intelligence subscription service operated by 30 Works (Pty) Ltd t/a 11&1 Agency (“MiaCreate,” “we,” “us,” “our”). By accessing this website, subscribing to, or otherwise using the MiaCreate platform, you (“you,” “the client,” “the user”) agree to be bound by these Terms and Conditions.

1. Overview

MiaCreate provides subscription-based creative and marketing-intelligence services that combine human expertise with data-driven insights, delivered through the MiaCreate platform and associated services.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements to use MiaCreate. By creating an account, you confirm that all information you provide to us is true, complete, and accurate, and you agree to keep it up to date.

3. Subscriptions and Payment

• Subscriptions are billed monthly, in advance, on the date you first subscribed (or the applicable renewal date).
• Payments are processed through our authorised payment partners; we do not store full card details ourselves.
• Subscriptions renew automatically at the end of each billing period unless cancelled beforehand in accordance with Section 4.
• Unused credits, allowances, or deliverables generally do not carry over between billing periods unless we state otherwise in writing.
• We may adjust pricing from time to time; where we do, we will give you reasonable advance notice before the change takes effect for your account.

4. Cancellations and Refunds

Cancellations, refunds, and free-trial terms are governed by our Refund Policy, which forms part of these Terms and Conditions.

5. Intellectual Property

• Completed creative work becomes your property once it has been paid for in full.
• We may display completed work in our portfolio or marketing materials unless you ask us in writing not to.
• All underlying AI models, tools, workflows, templates, and frameworks used to deliver the service remain the intellectual property of 30 Works (Pty) Ltd t/a 11&1 Agency, whether or not they are used in producing your deliverables.

6. AI and Automation

MiaCreate uses artificial intelligence to generate preliminary content and insights, which are reviewed by our creative and analytics staff before delivery. Because AI-assisted output can vary, minor differences between runs or drafts may occur, and we do not guarantee a specific output for any given prompt or brief.

7. Client Responsibilities

You agree to provide accurate and complete information and briefs, to review and approve deliverables in a timely manner, and to ensure that any materials you submit to us (images, copy, data, brand assets, and the like) are properly owned or licensed by you for our use in delivering the service.

8. Limitation of Liability

To the maximum extent permitted by law, our liability to you under these Terms is limited to direct damages only, excludes indirect, incidental, or consequential loss, and in any event is capped at the total fees you paid us in the three (3) months preceding the event giving rise to the claim.

9. Confidentiality

We treat your account data, briefs, and project materials as confidential, and we apply reasonable technical and organisational security measures to protect them, consistent with our Privacy Policy.

10. Termination

We may suspend or terminate your access to MiaCreate for misuse of the platform, non-payment, or breach of these Terms. Deliverables that have already been paid for in full remain your property notwithstanding termination.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. The parties will first attempt to resolve any dispute arising from these Terms through good-faith negotiation. If a dispute is not resolved within 14 days, it will be subject to the exclusive jurisdiction of the courts of Cape Town, South Africa.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

14. Updates to These Terms

We may revise these Terms from time to time. Updates take effect once posted to this page, and continued use of MiaCreate after an update constitutes acceptance of the revised Terms.
