1. Overview

MiaCreate provides subscription-based creative and intelligence services that combine human expertise with data-driven insights. Subscriptions grant access to creative deliverables, design credits, and intelligence reports according to the selected plan.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement. By subscribing, you confirm that the information you provide is true, complete, and accurate.

3. Subscription and Payment

• Subscriptions are billed monthly in advance.
• Payments are processed securely through our authorised payment partners.
• Subscriptions renew automatically unless cancelled prior to the next billing cycle.
• Credits or unused deliverables do not roll over unless otherwise stated.
• We reserve the right to adjust pricing or plan features with prior notice.

4. Cancellations and Refunds

• You may cancel your subscription at any time via your account portal or by contacting support.
• No refunds are provided for partial months, except where required by law.
• Free trials are limited to one per company or individual and cannot be repeated.

5. Intellectual Property

• All creative work produced under your subscription becomes your property upon full payment.
• MiaCreate retains the right to showcase non-confidential work for portfolio or marketing purposes.
• All AI models, tools, workflows, and frameworks remain the intellectual property of 11&1 Agency.

6. Use of AI and Automation

MiaCreate uses artificial intelligence to assist in generating insights and creative ideas. AI outputs are reviewed by our creative team before delivery. You acknowledge that minor variations or interpretive differences may occur.

7. Client Responsibilities

You agree to:

• Provide accurate and timely information for all briefs.
• Approve deliverables within reasonable timeframes.
• Ensure that all materials you submit (logos, copy, imagery) are owned or licensed by you.

8. Limitation of Liability

To the fullest extent permitted by law:

• MiaCreate shall not be liable for any indirect, incidental, or consequential damages.
• Our total liability in any case shall not exceed the amount paid by you during the 3 months preceding the claim.

9. Confidentiality

We treat all client data, briefs, and projects as confidential. Our team and systems adhere to strict data security and confidentiality protocols.

10. Termination

We may suspend or terminate access to the platform for misuse, non-payment, or breach of terms. Upon termination, you will retain ownership of completed deliverables already paid for.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa, and any disputes shall be resolved in the courts of Cape Town.

12. Updates to Terms

We may revise these Terms periodically. Updates will take effect upon posting to the MiaCreate website.
